This page explains how a copyright owner can tell us about material on our site that they believe infringes their work, what we do when we receive a notice, and how someone whose material was removed can respond. It follows the notice-and-takedown process of the US Digital Millennium Copyright Act (DMCA). For trademarks, logos on customer orders and our own designs, see our <a href=\"/intellectual-property-policy/\">Intellectual Property Policy</a>.</p>\n<section class=\"policy-summary\">\n<h2>DMCA in brief</h2>\n<ul>\n<li>Send copyright notices by email to <a href=\"mailto:support@capcraze.shop\">support@capcraze.shop</a> with the subject line &#8220;Copyright notice&#8221;.</li>\n<li>Include all six elements listed in section 3, so we can act without going back and forth.</li>\n<li>We review complete notices promptly and remove or disable access to material that appears to infringe.</li>\n<li>If your material was removed by mistake, you can send a counter-notice (section 5).</li>\n<li>Postal address for notices: Cap Craze, 210 W Illinois, New Baden, IL 62265, US.</li>\n</ul>\n</section>\n<h2>1. What this page covers</h2>\n<p>This process is for copyright: original creative works such as artwork, illustrations, photographs and written text. On a cap store, copyright questions usually come up in three places:</p>\n<ul>\n<li><strong>Design artwork</strong> shown in product images, for example a graphic on a trucker hat or a crest on a golf cap.</li>\n<li><strong>Product photos and text</strong> on our pages.</li>\n<li><strong>Customer-supplied files</strong>, such as a logo or photo a customer sent for a personalised cap, if any such material were to appear on the site.</li>\n</ul>\n<p>Names and logos used as brands (trademarks) are handled through our <a href=\"/intellectual-property-policy/\">Intellectual Property Policy</a>, although you are welcome to use the same email address for both.</p>\n<h2>2. Before you send a notice</h2>\n<p>Please check two things first. Is the material really on capcraze.shop? Copies of our pages on other websites are outside our control, and notices about them should go to the site that hosts them. And is the use actually unauthorised? Some uses may be licensed or allowed by law, such as a short quotation. If you are unsure, you can contact us informally first and we will tell you what we know about the material.</p>\n<h2>3. How to send a copyright notice</h2>\n<p>Email <a href=\"mailto:support@capcraze.shop\">support@capcraze.shop</a> with the subject line &#8220;Copyright notice&#8221;, or send it by post to Cap Craze, 210 W Illinois, New Baden, IL 62265, US. A complete notice contains all of the following:</p>\n<ol>\n<li>A physical or electronic signature of the copyright owner or of a person authorised to act on their behalf.</li>\n<li>Identification of the copyrighted work you believe has been infringed. If several works are involved, a representative list is enough.</li>\n<li>Identification of the material you believe is infringing, with enough detail for us to find it, ideally the exact URL of each product or page on capcraze.shop.</li>\n<li>Your contact details: name, postal address, telephone number and email address.</li>\n<li>A statement that you have a good-faith belief that the use of the material is not authorised by the copyright owner, its agent or the law.</li>\n<li>A statement that the information in the notice is accurate and, under penalty of perjury, that you are the copyright owner or are authorised to act on the owner&#8217;s behalf.</li>\n</ol>\n<p>Screenshots, links to your original work and the date it was first published are helpful extras, but they do not replace the six elements above.</p>\n<h2>4. What we do when we receive a notice</h2>\n<table class=\"policy-table\">\n<caption>How a copyright notice is handled</caption>\n<thead>\n<tr>\n<th scope=\"col\">Step</th>\n<th scope=\"col\">What happens</th>\n</tr>\n</thead>\n<tbody>\n<tr>\n<td>1. Acknowledge</td>\n<td>We confirm by email that we received your notice.</td>\n</tr>\n<tr>\n<td>2. Check completeness</td>\n<td>If an element is missing, we tell you what we need. Incomplete notices may not be acted on.</td>\n</tr>\n<tr>\n<td>3. Remove or disable</td>\n<td>For a complete notice, we promptly remove the material or disable access to it, for example by unpublishing a product page or replacing an image.</td>\n</tr>\n<tr>\n<td>4. Inform</td>\n<td>Where the material came from someone else (for example a file a customer supplied), we tell that person about the removal and their right to send a counter-notice.</td>\n</tr>\n<tr>\n<td>5. Close</td>\n<td>We email you to confirm what we did.</td>\n</tr>\n</tbody>\n</table>\n<p>Removing material does not mean we agree that it infringes; it means we are following the process. We keep a record of notices and our actions.</p>\n<h2>5. Counter-notice</h2>\n<p>If material you provided was removed and you believe it was removed by mistake or misidentification, you can send a counter-notice to the same email or postal address. It must include:</p>\n<ol>\n<li>Your physical or electronic signature.</li>\n<li>Identification of the material that was removed and where it appeared before removal.</li>\n<li>A statement under penalty of perjury that you have a good-faith belief the material was removed or disabled as a result of mistake or misidentification.</li>\n<li>Your name, address and telephone number, and a statement that you consent to the jurisdiction of the federal district court for your address (or, if you are outside the United States, any judicial district in which Cap Craze may be found), and that you will accept service of process from the person who sent the original notice or their agent.</li>\n</ol>\n<p>When we receive a valid counter-notice, we forward it to the person who sent the original notice. If they do not tell us within the period set by law that they have filed a court action, we may restore the material.</p>\n<h2>6. False or misleading notices</h2>\n<p>Please be accurate. Under US law, a person who knowingly makes a material misrepresentation in a notice or counter-notice can be liable for damages, including costs and legal fees. If you are not sure whether something infringes your rights, consider getting legal advice before sending a formal notice.</p>\n<h2>7. Repeat infringement</h2>\n<p>Where appropriate, we stop accepting orders or files from people who repeatedly send material that infringes other people&#8217;s copyright.</p>\n<h2>8. How this connects to personalised orders</h2>\n<p>Most of our caps are made from text and files sent by customers. We do not publish customer files on the website, and we delete logos and photos 30 days after delivery as explained in our <a href=\"/privacy-policy/\">Privacy Policy</a>. Our <a href=\"/terms-of-service/\">Terms of Service</a> require customers to send only material they own or have permission to use, and we refuse orders that clearly use someone else&#8217;s artwork, characters or team logos. If you believe a cap made by us used your copyrighted work, write to us with the details you have, even if the item is not on the website, and we will look into it.</p>\n<h2>9. Our own designs</h2>\n<p>The ready-made designs on capcraze.shop, such as our sunset stripes, mountain line, hole-in-one badge and Mulligan Club crest, are Cap Craze designs. If you see them copied elsewhere, we would appreciate a short email with a link.</p>\n<h2>10. A quick checklist for rights owners</h2>\n<ul>\n<li>Subject line: &#8220;Copyright notice&#8221;.</li>\n<li>Exact capcraze.shop URL for each item.</li>\n<li>Link to or description of your original work.</li>\n<li>Your full contact details.</li>\n<li>The two required statements (good faith; accuracy under penalty of perjury).</li>\n<li>Your signature (a typed full name is accepted as an electronic signature).</li>\n</ul>\n<h2>11. Response time</h2>\n<p>We reply to all emails within 24 hours on business days. Complex notices may need a little longer to investigate, but we always confirm receipt within that time and keep you informed.</p>\n<h2>12. Copyright or something else?</h2>\n<p>Rights owners sometimes send a copyright notice when the real issue is a trademark or a name. This table helps you pick the right route; both go to the same mailbox, but the right label speeds things up.</p>\n<table class=\"policy-table\">\n<caption>Choosing the right type of report</caption>\n<thead>\n<tr>\n<th scope=\"col\">Your concern</th>\n<th scope=\"col\">Type</th>\n<th scope=\"col\">Where to start</th>\n</tr>\n</thead>\n<tbody>\n<tr>\n<td>A graphic, illustration or photo you created appears on our site</td>\n<td>Copyright</td>\n<td>Formal notice on this page</td>\n</tr>\n<tr>\n<td>Product text copied word for word from your site</td>\n<td>Copyright</td>\n<td>Formal notice on this page</td>\n</tr>\n<tr>\n<td>Your brand name or logo used on a cap</td>\n<td>Trademark</td>\n<td><a href=\"/intellectual-property-policy/\">Intellectual Property Policy</a></td>\n</tr>\n<tr>\n<td>Your name or likeness used without permission</td>\n<td>Privacy or publicity rights</td>\n<td>Email us with the details</td>\n</tr>\n<tr>\n<td>Someone copied a Cap Craze design</td>\n<td>Our rights</td>\n<td>Email us with a link</td>\n</tr>\n</tbody>\n</table>\n<h2>13. Common questions about DMCA notices</h2>\n<h3>Can I send a notice from outside the United States?</h3>\n<p>Yes. Cap Craze is a US business, so we follow the US process, but anyone can send a notice. Please include all six elements in English.</p>\n<h3>Can a lawyer or agent send the notice for me?</h3>\n<p>Yes. An agent can send it, as long as the notice says they are authorised to act for the copyright owner and includes their contact details.</p>\n<h3>Will you tell the other person who I am?</h3>\n<p>If the material was supplied by someone else, we may forward your notice, including your contact details, to that person, because the law gives them the right to respond. Please only include information you are comfortable sharing for that purpose.</p>\n<h3>Do you need the original files of my work?</h3>\n<p>No. A link to where your work is published, or a clear description, is usually enough. We may ask for more if we cannot identify the work.</p>\n<h3>Is an email enough, or do I need to send paper?</h3>\n<p>Email is enough and is the fastest way. A typed full name at the end of your email counts as an electronic signature.</p>\n<h3>What if the item has already sold out or the page is gone?</h3>\n<p>Tell us anyway. We can check our records, make sure the design is not used again and let you know what we found.</p>\n<h2>14. Our commitments to rights owners</h2>\n<ul>\n<li>We read every notice ourselves; there is no automated rejection.</li>\n<li>We do not ask rights owners to pay anything or to buy anything in order to have material removed.</li>\n<li>We keep your notice confidential except for forwarding it to the person who supplied the material, where the law gives them a right to respond.</li>\n<li>We tell you clearly what we did, and if we decide not to remove something, we explain why.</li>\n<li>When a design is removed after a valid notice, we do not quietly bring it back under a different name.</li>\n</ul>\n<h2>15. Timeline you can expect</h2>\n<p>From the moment a complete notice arrives: confirmation of receipt within 24 hours on business days; review and, where appropriate, removal promptly after that; and an email to you describing what we did. Counter-notices follow the timelines set by law, which we explain to both sides when they apply.</p>\n<h2>16. Other questions</h2>\n<p>For anything that is not a copyright notice, such as an order, a return or a delivery, please use the <a href=\"/contact-us/\">Contact Us</a> page or the <a href=\"/help-center/\">Help Center</a> so your message reaches the right place quickly.
